Appendix A
Terms & Conditions
The agreement between you and the people who keep the app running.
These terms are the agreement between you and Vixen Tech s. r. o., Jelenia 1, 811 05 Bratislava, Slovakia, company ID 55 516 904, which runs InkyWord ("we", "us"). They cover your account, the writing you keep here, and what each of us can expect from the other. By creating an account, you accept them.
Early Access
InkyWord is in Early Access: it works, but it's young, and it changes often. Features may arrive, change or go away, and things will sometimes break. Your feedback shapes what it becomes.
While Early Access lasts, InkyWord is free, and no card is required. If we start charging when it ends, we'll tell you at least a month before, and nothing will be charged without you choosing a plan.
Founding Discount
As thanks to the writers who help shape InkyWord, we plan to offer a founding discount when paid plans arrive. The amount isn't set yet, and the details below are our plan rather than a promise; we'll confirm them before Early Access ends. As we plan it:
-
It's for writers who actively use InkyWord before Early Access ends: by then, they've written at least 250 words a day in their chapters (about a manuscript page) on at least 7 different days. Creating an account and leaving it unused doesn't count.
-
The first 100 writers to reach their 7th such day keep their discount for as long as they have their account, even if they pause their subscription and come back.
-
Every other active writer keeps it for as long as they stay subscribed without a break. Cancelling, or letting a subscription lapse, ends it.
-
It applies to every plan we offer, now or later, whether paid monthly or yearly.
-
Discounted prices only rise to keep up with inflation, or to cover what new features cost us to run, such as paid services they depend on.
-
If a plan is withdrawn, the discount moves to the plan that replaces it. If InkyWord closes, the discount ends with it.
-
Writing is for writing: we may leave out accounts that pad their days with filler, pasted or generated text to qualify.
Your Account
You need to be at least 15 to create an account, and if you're under 18, you need a parent's or guardian's permission. Give a name and an email address that are yours, and keep your password and passkeys to yourself; you're responsible for what happens through your account. If you think someone else has got into it, change your password and tell us.
Your Writing Is Yours
Everything you write here stays yours: your manuscripts, your story bibles, your covers and your notes. We claim no ownership of it.
To run InkyWord, you give us permission to store your writing, keep backups of it, and show it to you and to the people you choose to share it with. That permission is only for running the app for you, and it ends when you delete the writing or your account, except for copies in backups, which expire on their own.
We don't sell your writing, publish it, or use it to train AI models.
Sharing With Others
You can invite co-writers to a world, and share chapters with beta readers. The people you invite see what their role allows: beta readers only see the chapters you share with them, and their comments, reactions and answers stay with that world's writers.
Only invite people you trust with your writing. What they do with what they've read is between you and them.
Using InkyWord Fairly
Don't use InkyWord to:
- break the law, or store or share writing you don't have the right to;
- harass, threaten or deceive anyone, including the people you invite;
- get into accounts, worlds or chapters that aren't shared with you;
- overload, probe or disrupt the app, or get at it other than through its own pages and API;
- resell or rebrand the app.
Fiction is welcome to be dark. These rules are about what you do with the app, not the stories you tell in it.
Support Reports and Ideas
When you send a bug, idea or question from Support, the people running InkyWord read it and may reply. If you suggest an idea, we may build it without owing you anything for it; your writing stays yours either way.
Keep Your Own Copies
We back up what you keep here, but no service is perfect, and in Early Access less so. Export your books from time to time, so a copy of your work is always in your own hands.
Changes to These Terms
We may update these terms as InkyWord grows. The date at the top says when they last changed. If a change matters, we'll tell you before it applies and may ask you to accept the new terms to keep using your account.
Ending Your Account
You can delete your account at any time from your account page. That deletes it, and the worlds you own with everything in them, right away; it leaves the worlds others own. Export anything you want to keep first.
We may suspend or close an account that breaks these terms, telling you why when we can. If we ever close InkyWord itself, we'll tell you at least a month before, so you have time to export your writing.
No Warranties
InkyWord is provided as it is, in Early Access, without warranties of any kind, as far as the law allows. We don't promise it will always be available, or free of mistakes.
Liability
As far as the law allows, we're not liable for indirect or consequential losses, or for lost writing, profits or data, arising from your use of InkyWord. Our total liability to you is limited to what you've paid us for InkyWord. Nothing in these terms limits rights you have under the law that can't be limited.
The Law That Applies
These terms are governed by Slovak law, and disputes go to the Slovak courts with jurisdiction over our registered office. If you live elsewhere in the EU, you keep the protection of the consumer law where you live, and can also take a claim to your own country's courts.
Consumer protection in Slovakia is supervised by the Slovak Trade Inspection (SOI), Bajkalská 21/A, P. O. Box 29, 827 99 Bratislava, podnety@soi.sk. If we can't settle a dispute between us, you can also turn to alternative dispute resolution.
Questions
Ask us anything about these terms, or send a complaint, through Support in the app, by email to oc.hcetnexiv@xela, or by post to Vixen Tech s. r. o., Jelenia 1, 811 05 Bratislava, Slovakia. We'll answer complaints by email, without undue delay. Read how we look after your information in the Privacy Policy.
